Effective October 1, 2023, a Florida Legislative Act relating to local ordinances went into effect. The bill pertains to the passage and challenging of local ordinances.  It adds to the process for local governments passing ordinances and gives certain additional rights to those challenging local ordinances.  It amended F.S. 166.041(4), by requiring a "business impact statement" be produced prior to the enactment of a proposed ordinance (unless a proposed Ordinance is considered exempt per F.S. 166.041(4), and in accordance with the provisions of F.S. 2023-309. The Business Impact Statement must be published on the local government's website and include certain information, such as the proposed ordinance's purpose, estimated economic impact on businesses, and a good faith estimate of compliance costs, and any other additional information the governing body determines may be useful.  These statements will be posted on this page.
